But that's my point. We all surmise that there was tampering, both at Miami and at LSU. This is big business and people don't fuck around and therefore take calculated risks. The issue is proving it. You just articulated why Wisconsin may have a hard time proving Miami tampered. The kid's from Florida. Wanted to go home. Whatever. With a contract claim, you don't have to go beyond the four corners of the document, and in this case the breach has been announced publicly by the breaching party.
I'm not sure that the position a kid plays or their class year is going to matter much in either type of cause of action other than to bolster the claim for damages. In that one sense, the Wisconsin freshman might be thought to have caused more damage because he would have been there longer. QB, OTOH, carries a bigger premium. But before you get to damages you have to prosecute your case, either in tort or in contract. I'm just saying the tort case is harder to win.

I'm not an attorney but as I understand it, the contract law is pretty clear.
Regarding the tort case, can they not drop a draft complaint? If I'm LSU, I would not want to go into discovery and I'm pretty sure that most tort cases settle before court anyway.
