It isn't, of course. A majority of Daddy's nominees are thankful Kennedy didn't ask them about it.

If he didn't know exculpatory evidence has to be shared with the defense, that would be surprising. That he didn't know the defense tool for challenging the prosecution's adherence to that principle is called a "Brady motion", is not that surprising. Most lawyers don't practice criminal law. He's never presided over a criminal case. -
Not if you're watching CNN, MSLSD and the rest of the corrupt media like Dazzler.Bob_C said:

Since you don’t know or practice criminal law, you would make such an ignorant declaration.HHusky said:

Brady motions are pretty standard in criminal cases, you dumbfuck. Every public defender, law school student, investigator et al knows what it is.
Withholding exculpatory evidence in a criminal case prior to trial is a BIG no no.
Let me rephrase your statement: I’m a blowhard and like to blow smoke. What kind of law do you practice again? Business law?

Bob gave a correct definition of a “Brady Motion”in the first post of this thread. Your definition is incorrect.HHusky said:

I’ll post a correct definition again to help you out.
https://www.shouselaw.com/ca/defense/legal-defenses/brady-motion/
“A Brady motion is a defendant’s request for the prosecution in a criminal case to turn over any potentially exculpatory evidence (which means evidence that may be favorable to the accused).
Defense attorneys generally bring this motion as part of the pretrial process, or later in a case, or when they believe that prosecutors are withholding such information.”
A Brady motion is almost universally part of the pretrial process . . . at least in federal criminal cases. -
Biden appoints a judge who doesn't know the law and H is all over posters here about whether they knew the law
Imagine a so called lawyer making arguments like that
It will only get better as standards are reduced and erased for law school. I mean H allegedly passed law school and the bar 80 years ago. Worse than that -
Good God a law clerk knows this shit! Brady is an every day thing in LE! If an officer holds something back they get a Brady tag from the DA's office and if somehow they keep their job the DA will have nothing to do with any case they are involved in. EVER! It is a career ender either way. They spend their time managing vehicle maintained or counting paper clips.HHusky said:

Not believing the whole I'm an attorney schtick now. -
I love it when the girls who didn't go to law school tell me that certain terms are used every day there.
Meanwhile, an all-jurisdiction case search reveals that many US jurisdictions have exactly zero cases (published or unpublished) using the term "Brady motion" while some jurisdictions use the term extensively. (Colorado has zero such cases, btw. California has hundreds.)
Pulling up a Crim Law text at random just now and doing a word search yielded ZERO hits for "Brady".
It's a gotcha, and not a particularly good one. -

Bringing facts to a discussion is so unfair, I know. I certainly bow to your vast experience participating in Brady violations, Mall Cop.Sledog said:
