    The first 8 shots or defensible ... the last one not so much ... Will probably lead to manslaughter, if Perp was of different color, probably Not Guilty...

    But if deadly force was justified in the first instance, can you really recommend he be charged when it's essentially all one event without any meaningful interruption?

    I don't think he gets indicted.
    Most self defense law only protects you when you are under threat, anything after that would not be considered Self defense...in this case he knows the threat is neutralized (grabs the guys gun), then Fires another round...aka Murder/Manslaughter. Could he say he wasn't sure if the guy had another gun, yes, but I wouldn't want to have a jury decide if they believe me or not...
    What was the cause of death? Bullets 1-8 or number 9. In Texas, he gets to testify he was still scared for his life and the other patrons. In that part of Texas, he walks as he should.

    Last story I saw was that police did not want him for any crime but just to interview him. So a HH style shitbag DA wants to charge him? Good luck with that. Guys waving guns threatening to shoot people during a robbery are fair game in any state.

    After bullet 1-8 the guy could have rolled over and shot a few people (had he a real gun). Guns are no good unless you use them with deadly force. Bullet 9 was needed.

    Dazzler would have asked the thug if he could be of assistance so people could finish eating their tacos. He didn't shoot anyone for their money, did he?

    SO you didn't watch the video ... shots 1-4 are fine, Perp falls to ground gun flys away from him... pause in shots, Shots 5-8 are fired... Shooter walks over, grabs the Perp Gun (threat neutralized), shoots Perp in the head.

    I wouldn't want a jury to decide my fate in this if I was the shooter.
