Every other judge who looked at this understood that a systematic purge like this has to be completed 90 days prior to a federal election, just as the law explicitly provides. Now you like judicial activism. Very principled.
So you are you saying that they can shove illegals onto voter rules on day 91 and if they don’t catch it in one day there is nothing that can be done to rectify already illegal behavior?
First, laws are made by Congress, so take it up with Congress.
Second, if you have a list of alleged noncitizens who are registered, then prosecute them.
Third, you'll also know for a fact whether a ballot was cast in the name of any of these alleged "noncitizens", allowing for the election to be challenged and for the guilty (if any) to be prosecuted.
Fourth, even Virginia isn't suggesting that your hypothetical is what took place, and you know it didn't because a government effort like this isn't launched within 24 hours.
I prefer to just not allow them to commit the crime of voting when they aren’t allowed to. Seems like entrapment to give them a ballot and wait for them to vote it before prosecuting.

Illegal voting is prosecuted in every State in the Union. Evidence is easily gathered. But the crime itself exceedingly rare; disenfranchising legitimate voters through voter roll purges is many times more common and more likely.
