Know that many dog walking businesses and house painting companies 1099 the kids who are in reality employed by them? I’m a lawyer and a parent. It’s not a well kept secret. The “independent contractor” dodge has been around for decades.DJDuck said:

This isn't unusual. There a lot of employees that try and 1099 workers than making them employees. These advantages include, not having to have worker's comp insurance, not having to pay their share of the workers social security tax, and being subject to less strict employment laws. Employers try so hard in fact, that they misclassify these workers as independent contractors. These standards aren't anything different than what I've seen before.

Gutted all the side work economy in California and is totally fucking up the media/arts industry. Lots of friends who are looking for new lines of work atm because *surprise* there's less flexibility in hiring and companies will just demand less labor if the cost of said labor goes up.

If the counselor could actually read a statute and understood the traditional definition of independent contractor he could have added to the conversation. Traditionally, say an Uber driver or a freelance journalist would be a legitimate independent contractor. They own their own tools, set their own hours and don’t have to work if they don’t want to. This law would say that an Uber driver provides the service that Uber (the employer) is selling and therefore fails the new test and therefore must be treated as an employee.
Some employers fraudulently treat true employees as independent contractors. This is against the law and the law has clear remedies for an employee to pursue. Rather than debate whether Uber drivers should now be treated as employees, the counselor chose to run cover for the dems and the unions. No wonder we used to call him Mr. Conservative.

Pardon me but this is another stupid post. You claimed “NOBODY (BUT NOBODY) enjoys freelancing.” You can’t prove that and it is not true. I have been an independent contractor and have known hundreds of people that have been independent contractors. Everyone I know loved it and preferred it that way. If you are going to post on a subject you might want to have some knowledge about it.HHusky said:
