He was told he could speak freely in a civil suit and that was used against him in the criminal trial thus taking his 5th amendment right. It is portrayed as a fuck up by the previous DA that gave him the deal
It's very hard to see why the prior DA gave him that deal. If he'd taken the 5th in a civil trial, the jury would have been instructed that they could infer his answer would be incriminating. Seems like the State gave up its power to prosecute for no tangible net benefit to the victim.
