Shaller was inclined to delare a mistrial if the jury couldn't progress by that afternoon. But when the jury foreman asked for a translator to assist the juror struggling to understand English and McNair's attorneys expressed concern the juror wasn't actively participating in deliberations, Shaller dismissed her and summoned an alternate.
Pretty sure I wouldn't want a dude who doesn't speak English deciding the fate of my $27MM case, or defense of said case.
