If this turns out to be true, they can and should throw him off the bench on ethics grounds. I clerked for the 9th circuit (for pretend). My judge was squeaky clean. There are normal people out there. There's nothing normal about asking that of his law clerks.

My grandfather always said, "don't shit near the table." Dogs don't even like to shit near their food dish. What is it with these guys that they just can't go out to a bar or something? You don't do things like that at work, particularly when you're in a position of authority.

And, let me tell you, because I've actually spent time with this guy, Kozinski is fricking' brilliant, so it would be a shame to lose his intellect from the federal bench. But that can't go without repercussions.

Let me tell you, when the circuit judges would come sit in Seattle, it was a hell of an opportunity to be around some serious brain power. This guy ... if you wanted to intellectually spar with him, which he fully encouraged, you needed to bring your big boy pants with you. Either way, it was rough. Very, very incisive intellect on that one. But, you gotta behave like the rest of us.
