Title IX makes schools run these sexual assault boards at which oftentimes the accused doesn't have a right to an attorney, doesn't have the right to question the alleged victim, etc. etc. etc.
The standard of proof at these boreds is "preponderance of the evidence." More likely than not, in other words.
So, based on very little circumstantial evidence a "he-said/she-said" drunken hookup can be found to be a sexual assault and the "perpretrator" (the guy) will get expelled.
The players at UM are demanding a full trial for their fellow player, but the Hennepin County DA chose to not prosecute the case (because the facts are lousy, and DA's don't prosecute cases they aren't going to win, usually).
The UM also went after a bunch of students who were present or had knowledge of the alleged sexual assault but did not come forward or make a statement to the bored.
I say Kudos to the Gophers, and they should be given a free trip to San Diego to bang sloots.
