Whether the Maine Secretary of State has the authority to remove a known insurrectionist from the ballot under Maine law can still be litigated. And even if so, the SCOTUS can still be asked to determine whether Maine law is preempted by Federal law.

Maine law also allows for impeachment of the Secretary of State. Which is now in the works.
