And yet even as Capitol Hill has weakened itself, the Senate has retained one critical function: confirming those many judicial nominees who rule on those many partisan lawsuits. From the Supreme Court to the federal circuit courts, America’s senators are choosing the elite group that has dictated and will continue to dictate the nation’s future.

None of this is to say the House is wholly without power. Democrats will almost certainly use their majority to launch investigations of Trump and the Republicans, or even start impeachment talks against the president.

But make no mistake, governing power now sits in the Senate vis-a-vis the judiciary.

Unfortunately for the Democrats, that’s incredibly bad news. On Tuesday, Republicans added to their once-slim Senate majority with what will likely be five new seats when the final votes are counted.

Make no mistake, Majority Leader Mitch McConnell of Kentucky will put that additional firepower to work. He and his colleagues have already confirmed Justices Neil Gorsuch and Brett Kavanaugh to the Supreme Court bench, with a clear eye on replacing the aging Justices Ginsburg and Breyer.

Additionally, Republicans will continue adding to the already impressive 29 circuit court judges confirmed during Trump’s first two years. That’s a record for any modern president.

Smart Democrats are bitterly aware of this development, with the minority recently lashing out at McConnell for pushing through judicial nominees while the Senate was technically in recess.

Me - this is not good for the country long term regardless.

    They should talk Clarence Thomas into retiring and get some 40 year old arch Conservative to replace him. If RBG or Breyer croak between now and the next election they could replace them as well, Maybe Cruz would take a seat on the SC. He has to see that he is never going to be a loved politician and I like the guy.

    Cruz is a rock solid conservative. Does he support what I support and is he the most conservative person in the race? Those are my criteria on whether I like a politician. Unlike you Obama blowjob boys or as we saw with Beto and his supporters, I'm not looking for a boyfriend.

    Pelosi and the rest of the D's in the House would be wise to work with Trump if they are to make additional gains in 2020. Resist, impeachment talk and investigations for the next 2 years will not fly with most of the electorate. Trump has already threatened Mutually Assured Investingation if Pelosi and Waters move forward with their threats.

    Take away the Never Trumpers Flake, McStain, Corker and Trump was operating with only 48 reliable votes in the Senate for most of the past 2 years. With a projected 55 Senate seats, Trump will gain 7+ seats, a pretty remarkable feat.

    judges should never be legislating from the bench. They should be basing their rulings on the law.

    Too many, like most appointed by Inslee, were never good lawyers, but were loyal partisan ass-kissers who don't let little things like the Law interfere with their paybacks.
