Not the case. I think Bergdahl is a pathetic piece of shit who never should have made it past a recruiter. But I also think that 5 years in a Taliban cage is sufficient under the circumstances.Sledog said:

He is handing one of the best private practitioners of military law grounds for appeal in a case where the Defense already got a favorable result. Given that the crime hapened in 2009, the version of the Code then in effect gave the commanding general plenary authority to do whatever he feels like with the case. For that matter, the MJ still owns the case.
Those are the outer edges of what Frank Spinner can now request on his inevitable UCI appeal.
I might actually give a shit about Trump's opinion on this if he wasn't such a draft dodging pussy. Those bone spurs must have been nasty. -

(a) No authority convening a general, special, or summary courtmartial, nor any other commanding officer, may censure, reprimand, or admonish the court or any member, military judge, or counsel thereof, with respect to the findings or sentence adjudged by the court, or with respect to any other exercises of its or his functions in the conduct of the proceedings. -
