The President has executive powers to execute the law of the land. What the dementia patient did was to ignore our federal immigration statutes. Trump is using the law from 1798 to justify the deportations and ignore due process by claiming we are being invaded by TDA and are effectively in a war against them. The law specifies it pertains to countries themselves at war with or invading the US. In which, in all 3 other circumstances, the US used it under an official declaration of war: against England, Germany and Japan. We’re not at war with Venezuela. We’re not at war with anyone. Unless Trump wants to go ahead and declare war on them, he’s going to have a hard time justifying the use of this act to ignore due process. Because I guarantee that is the first question SCOTUS will ask.
Nobody is saying TDA members should be allowed to stay in the country. I don’t want them here. But that’s where you girls always trip and face plant because you like to use your jump to conclusions mat and say because other people support the rule of law, that means we must be a bunch of commies who want violent gang members in this country. We don’t. But there’s a process and we have due process laws for a reason: to protect from situations where people who are not in fact part of these groups and are not committing crimes from also becoming victim to this.
