That's a bit of an overstatement. It's not confiscation "if found", it allows a very narrow use of confiscation if police invoke "community caretaking" during an arrest. Naturally this almost never happens (hence this case itself finally being heard by the courts because of a single instance of it being used).DerekJohnson said:

Ah the usual commie it ain't that bad shtick. It's bad. Community care taking normally is about property that could be stolen or lost. It's what is done when one impounds a car. It's searched so the property can be listed on the impound report and documented. The police don't take the property to the station and book it in. It's documented so if it disappears while the tow service has custody there is legal recourse. Taking property for the same reason from a private residence is not the same thing.
