There was an independent counsel statute as authorized by Congress, but it expired. Every US District Attorney is required to be confirmed by the Senate as an officer of the US. Jack Smith as a very special counsel has much more independent power than a US District Attorney. Plus case is a loser under the recent Presidential immunity ruling by the Supremes. Overseeing a federal election is very much in the Presidential overview of the President.

As for the dismissal of the entire Florida part of the case due to Aileen Cannon determining he was illegally appointed, he's submitted an appeal in which he attacks Cannon and suggests she's a rogue judge.
