Falsifying business records to cover up another crime has been a low-level felony in NY since at least 1986. It has been prosecuted as a felony frequently since then. The TugCon girls apparently dislike NY law, but because of their enormous respect for federalism and the notion that states are "laboratories of democracy", they are quietly respecting NY's sovereign right to enact such laws and to prosecute their violation.
