Push for a constitutional amendment. Pending that, cook up a decision based on stari decisis. They've invented rights out of whole cloth using that approach. Shouldn't be hard to decide a case and conclude that somewhere in the constitution, as currently written, there is a right to not be murdered that crosses state boundaries. That said, there's precedent for "violating civil rights" being prosecutable by the fed and arguably all people regardless of age have civil rights.
I'm personally against such an approach as we have hashed out before but the irony of civil rights law and fed power being turned on its head for a conservative cause would be pretty hilarious. Good for the gander...
