Why you should vote for GOP presidents
This is truly one of the worst laws on the books along with fake RICO investigations used to give lousy police and prosecutors home field advantage and then some
Asset forfeiture has been around for decades but as with most things, has taken the last 8 years off as an issue hiding out with the anti war crowd where ever they all go when a democrat is in office.
If you take the assets before the trial you limit the ability to hire a kick ass defense attorney and you fuck people over into basically having to take a plea deal.
Make no mistake, I don't agree with Trump, Obama, Bush, Clinton, or Bush on this law. Trump is shooting off his mouth as if this is par of law and order when it isn't. It is anti American.

Civil asset forfeiture is in many cases legalized robbery.

It really is one of the worst legal things we have in the US. The fact that you don't get your money back even if not charged with a crime is disgusting. When police start counting on it for budgets you know the problem has gone too far.

There was a bill cosponsored by by Rand Paul and Corey Booker (kind of an odd couple) that was trying to address this back in 2014. Shouldnt come as a surprise but it didn't get any traction:
