My general opinion is that the difference between 6 wins or 8 wins in this world is semantics and if you don’t view your roster as being a CFP challenger you’re probably better off keeping the spending on NIL at or below market values and save that $$$ until it can make a material difference

there is no feasible way to put any cap on what ppl are offered to play unless all the players agree to it. Furthermore there is nothing from stopping a booster from paying a player for appearances and/or being a spokesperson for their business. This likely never stops.

That easily could happen, we'll see how the 3rd party commission works. There is nothing to stop a booster from paying a player $50k for being a spokesman but it has to be at or below market rates next year. For instance, Phil Knight won't be able to pay someone $1 million to be a spokesman for Nike if hardly anyone has heard of them. IMHO, that's why he's spending so much now to buy guys in the portal and promising recruits money once they sign. There are no checks and balances right now so he's happy to spend whatever it takes with no limits.

I actually recently heard an interesting conspiracy theory that the Patriots and Kraft found a way to pay Brady outside of his NFL contract so they could have a bunch of cap space to sign other guys. In the NFL it seems what would stop this from being an actual thing or more of a thing is that you get punished if you get caught. Which is simply what it has to be in college.

so, who sets the market? nike? uncle phil? the clearing house? how would the clearing house determine how company values an athlete? again, who determines the going rate? whatever the market will bear of course.
no professional athletes have to go through a clearing house to justify their outside pay.

That would be wild, especially because they were already busted for videotaping the Rams' Super Bowl practice. I would think the NFL would take away multiple draft picks and reduce their cap by 15-20% if caught.
If the NCAA found out about something similar in their ranks, they would probably cut OV's in half and dock many scholarships or roster spots.

The 3rd party commission. I suspect anything above a certain threshold will get an analysis to see whether it makes sense for the local market the player will be in.

I'm not an attorney but that's possible. I imagine the player would likely need to demonstrate that they were somehow restrained by unfair practices, limited in their ability to negotiate fairly, and / or subjected to agreements that unfairly depressed their NIL value.
But the commission is probably going to give some leeway rather than be sticklers and will mostly be policing the more outlandish deals.

Exactly this, and furthermore there isn't a Governing Body in America naive enough to try and enforce this or put guardrails into place.
The trial lawyers lining up to get it into the court system if implemented could fill up Husky Stadium.
