Interpreting the facts of a particular case relative to the Constitution says is what the Supreme Court is authorized to do.
If the society changes, it is fully within the rights of the states to call a Constitutional convention and amend the document - as they did with Prohibition and then determined that was a fucktard move and repealed it via the same process.
The "living" constitutionalists are pinheads like Cho Bai Den.

U.S. private payrolls unexpectedly fell in January as a resurgence in COVID-19 infections disrupted business activity, the ADP National Employment Report showed on Wednesday.
Private payrolls dropped by 301,000 jobs last month, the ADP report said. Data for December was revised lower to show 776,000 jobs added instead of the initially reported 807,000. Economists polled by Reuters had forecast private payrolls would increase by 207,000 jobs.
“The labor market recovery took a step back at the start of 2022 due to the effect of the omicron variant and its significant, though likely temporary, impact to job growth,” Nela Richardson, chief economist at ADP, said in the report. -

During the segment, Exum revealed that she voted for Biden in the 2020 election, and now says she’s disappointed.
“Truth be told, this was literally my first time voting, and I voted for you [Biden] and I feel disappointed right now. I don’t understand,” she said. “I thought he was going to talk for the American people, basically, and not for himself,” she said.
“I don’t feel that he has done anything but disappoint,” she added. -
