Its not really a smack down... They essentially overturned the 3 judge panel appeal and then punted the football back to the original judge
The en banc rejected the mandamus but also denied the reassignment of a new judge and then just sent it back to the original corrupt judge (Sullivan) with little to vague direction.
The play by Sullivan is clear, drag out any possible dismissal hearing to beyond the election, Biden wins, appoint a new AG, re-destroy Flynn.
There is essentially nothing Flynn can do at this point to avoid being held as a political prisoner in limbo and bankrupt further by a clearly corrupt judge.
Some 3rd world country shit.
