It should be noted in the above letter to McCabe’s lawyers that the DOJ is “not bringing charges “ BASED ON THE OIG’s REPORT.”
It would seem to me that this would not preclude charges stemming from the Durham report and charges coming directly from him.

This is only related to the OIG's report of "lack of candor" in McCabe's testimony and has nothing to do with Durhams ongoing investigation into FISA abuses and McCabe's role.
