It is admitted that President Trump addressed a crowd at the Capitol ellipse on January 6, 2021, as is his right under the First Amendment to the Constitution and expressed his opinion that the election results were suspect, as is contained in the full recording of the speech. To the extent Averment 5 alleges his opinion is factually in error, the 45th President denies this allegation.

    And I was told by the real pollsters — we do have real pollsters — they know that we were going to do well and we were going to win. What I was told, if I went from 63 million, which we had four years ago, to 66 million, there was no chance of losing. Well, we didn’t go to 66, we went to 75 million, and they say we lost. We didn’t lose.

    I have, you're lying. Just because they cited the speech doesn't mean they cited it to claim that Trump won it in a landslide. They aren't making that argument and haven't made that argument. You're lying.

    You'll notice that Dazzler provides no links and no context as to why the lawyers cited Trump's speech. That's not an oversight, it's intentional.
